Official Contest Rules

NOTE: We do NOT redraw for unclaimed prizes. When prizes go unclaimed, we mention the winner’s name again, frequently, in future posts. If they are still unclaimed after several mentions, they are either returned to Stampendous stock in the case of our products, or they are put into a pool, in the case of other company’s products, to be offered in a new drawing in the future.

NO PURCHASE NECESSARY TO ENTER OR WIN.
A purchase does not improve your chance of winning. Void where prohibited, taxed or otherwise restricted by law. Subject to all federal, state, and local laws. Contestants may enter as many times as they like but for an entry to count it must include any relevant information requested in the contest rules & regulations post. Stampendous reserves the right to disqualify entries that contain “inappropriate” content as described in its Terms of Service and FAQ. A new Promotional Period begins with the publication of a new newsletter and ends with the publication of a subsequent newsletter.

This Sweepstakes is open to all legal residents of the United States and District of Columbia, and U.S. Military personnel (and their families) with APO/FPO addresses, and residents of US Territories where the contest is legal and where products such as Embossing Powders, Glitters, Mica Fragments, etc do not have to undergo customs scrutiny. Contestants must be eighteen (18) years of age or older. Participation in this Sweepstakes constitutes entrant’s full and unconditional acceptance of these Official Rules.


WHO CAN’T PARTICIPATE?

This Sweepstakes is open to all legal residents of the United States and District of Columbia, U.S. Military personnel (and their families) with APO/FPO addresses, Alaska and Hawaii, and residents of any US Territories where standard U.S. Postal rates apply and prizes do not need to undergo customs scrutiny, who are eighteen (18) years of age or older (void anywhere this contest is prohibited by law). Participation in this Sweepstakes constitutes entrant’s full and unconditional acceptance of these Official Rules. Prizes will not be mailed outside of the eligible areas listed above. Stampendous employees as well as employees and agents of collaborating companies are not eligible to enter or win.


HOW DO I ENTER?

For sweepstakes requiring only a comment, simply comment in the provided comment form on the applicable blog post. For sweepstakes requiring a created project, create a link to your posted contest entry on your own blog, website, or any public forum then click on the linky tool at the bottom of the applicable blog post. The tool will request the link to your project and your contest entry will be submitted. You should see your entry in the gallery in a short while. It is important to note that such postings are, by nature, public, and Stampendous is not responsible if your artwork, ideas, creations or designs are copied by other companies, artists, or craftspeople or used on other forums without your permission or credit being given to you. We strongly suggest that you watermark all public photos of your creations. Stampendous will not use your projects for any purpose beyond this blog and our other social media linked with this blog without asking your permission first.

All Internet access and usage charges are the responsibility of the entrant. If for any reason the Internet portion of the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion, to terminate, modify or suspend the Sweepstakes. All entries received on-line before the on-line portion becomes inoperable, will be included in the random drawing. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web-site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. In the event of a dispute, eligible electronic entries will be considered made by authorized account owner of the email address submitted at the time of entry. Entries generated by robots or scripts are considered to be a direct violation of sweepstakes policy and will result in immediate disqualification of any and all associated entries. Sponsor is not responsible for printing errors in these Official Rules.


WHAT CAN I WIN?

Prizes for the Stampendous Blog Sketch/Design Challenge include exclusive Stampendous Cling Rubber™ Stamps, Perfectly Clear™ Stamps, or other product. Choice of product is at discretion of Stampendous and will vary each contest period.

All warranties for prizes are hereby disclaimed, and the winner will accept the prize “as is”. Prizes cannot be assigned, transferred, exchanged, or redeemed for cash.


HOW DO I WIN?

For each contest announced, a given number of random winners will be chosen using http://www.random.org to select from the pool of entrants based on comments received on http://www.stampendousblog.wordpress.com or on linky tool gallery entries.


HOW IS A WINNER SELECTED?

The winner will be selected in a random drawing from all eligible entries received by Stampendous, whose decisions regarding all aspects of the Sweepstakes shall be final and binding. Prizes will be mailed within forty-five (45) days after winners are selected. If a winner declines to accept a prize, or in the event that a prize or prize notification is returned as undelivered, the winner will be disqualified and the Sponsor may elect, at its own discretion, to select an alternate winner, hold a future contest for that product, or return the product to inventory. By participating, entrants release Sponsor, its parent, subsidiaries, affiliated businesses, its advertising and promotion agencies and the officers, directors, employees and agents of each from any and all liability, damages or causes of action (however named or described) for injuries, damages or losses to persons and property which may be sustained in connection with receipt, enjoyment, ownership or use of the prize, and winner grants permission to Sponsor to use winner’s name, age, city, state, photograph or likeness for advertising and promotional purposes without additional compensation or approval (where lawful).


DISPUTES

Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.

Why do I need a U.S. Address to win?

We really appreciate all our international fans and friends. We are so thrilled that we are able to offer our products for sale internationally. In almost all cases this is done through international distributors who work with freight forwarders and customs officials to make sure that our products are labeled in accordance with the laws of different countries and are brought into the countries where we sell legally.  In mailing a sweepstakes prize internationally, these protections are forfeited. The winner is often required by their national customs service to pay extremely high fees to redeem their confiscated product, fees far more than the value of the product in question. In addition, Stampendous cannot be responsible for knowing where this type of sweepstakes is legal and where it is not outside of U.S. borders. Many countries do not allow their citizens to win international sweepstakes prizes and the awarding of those prizes in error could jeopardize our ability to sell our products in those countries in the future. We hope our international friends will continue to submit their projects for everyone’s enjoyment, and follow and comment on our blog hops, but please understand when we cannot send prizes to those who do not have U.S. Mailing addresses.  We do make every effort to determine whether a winner is in the U.S. or its territories before announcing a winner, please let us know ahead of time if you have a U.S. address to which we could mail your prize.

    • We would really love to open the competition to folks outside the US…we have so many international fans and we love them all. The problem comes in that mailing a prize internationally costs us more than the retail value of the prize itself. Our accounting department only lets us run contests if we keep the postage to an absolute minimum… We’ll certainly email you the project sheet for the bonus project though!

    So is PR eligible or not? You do not have to post this only clarify the rule please.

      • You might just add “U.S. possessions” (I hate that word) but I mail my eBay stuff to possessions for the same mail rate I send to any of the 50 states. Check me on that but I know my eBay stuff does go U.S.P.S. rates to all of them. You might also talk to stamp retailers and distributors in foreign countries to see if they would do your prizes instead of mailing them – it could only be great for THEIR business as well as opening up the contest to all nations — Lord knows we could sure use all the good will among nations that we can get and the arts community is a great place to start – never ceases to amaze me that WE can all come together yet our governments can’t – maybe we should insist that Congress start crafting LOL

      • We’ve tried to work with some of our international customers to fulfill prizes, it has sometimes worked out well, sometimes not. Wholeheartedly agree about international goodwill being beyond critical. If we could get EVERYONE to start crafting they’d have lots less time for war and things.

  3. How can I enter a contest if I do not have my own blog or website? I do post pics and belong to Club Ruby-can I use that website for my postings here and my entries?

    • Anywhere your creation you want to submit appears on the web, just go to it and copy the URL from the box at the top of your screen. That’s the link you paste into the Linky Tool.
      You can use a Flickr account, or Photobucket or another free service, too. Or you can link to your creation on a forum like SplitcoastStampers or Stamp Shack or somewhere else.

  5. Hello, any chance that you could soften the rules regarding eligibility of challenges. My suggestion would keep the buget department happy. Change the rules that RAKS are mailed to USA mailing address only. This would allow for Canadian’s who live at the border the opportunity to play in the challenges. I have a US mailing address.

  6. I agree that it would be great if you could arrange for a UK supplier to post prizes if won by a UK entrant. It does seem such a shame not to be eligible for prizes in your challenges. I have several of your lovely stamps and have just found your blog through entering the House Mouse Monday challenge in the UK

    • Mariette, we’re so sorry about our shipping limitations. A lot of it has to do with customs issues as well as the fact that contests and sweepstakes aren’t legal in many other countries, and we can’t be responsible for knowing all the laws everywhere. If we accidentally do something that’s illegal in the Netherlands, we could be prohibited by your customs department from shipping products to our customers there. That would be horrible! We keep trying to find a good solution to this problem, but we’d still LOVE to see your projects, feel free to link them to the challenge post.

  7. Tina Mcdonald is CANADIAN, so if she posts a product, & us CANADIANS can`t participate…what`s that telling us…..! I realize the postage thing & Customs, etc., but there are many U.S. Co., that mail to Canada & customers get their products. AAARRRRGG!

    • Thanks for your input, Susan. We understand and share your frustration. Our website sells to Canada, and we mail products directly to our Canadian customers from our warehouse. Of course those customers have paid dearly for that shipping charge, and we are legally able to do business in Canada. However, the issue is more that we are careful to comply with all US Regulations regarding contests and sweepstakes, but every country has its own laws and regulations. For example, if we ran a contest in Canada, we’d have to exclude Quebec because we’re not running our contest in French Canadian. Canada has many other regulations about online contests, and violating even one could jeopardize our ability to sell Stampendous products in Canada. That would make our Canadian fans much sadder than not being able to enter a contest. Many Canadians also maintain U.S. mailing addresses, and they are eligible to enter.
